1. Do Call The Police

Even if the accident was small, you should still call the police to get an official police report. This report will only serve to protect you if the other party were to file a lawsuit. If you don't have an official document, it can become a "he said, she said" battle. When the police come, they will take statements from both parties, as well as any eyewitnesses at the crash. This will help to get the most accurate account of what happened and determine which party was at fault, if any.

2. Don't Admit That You Were Distracted Or That It Was Your Fault

When you talk to the other party, you may be tempted to say something to diffuse the tension. You might say something like "I just looked back for one second" or "my kids were so loud I could hardly pay attention" and so forth. These kind of statements should be avoided and instead you should never admit that you did anything wrong in front of the other party. If you did make a wrong choice, you should only discuss these problems with your attorney. They will help you know how to handle the situation so that you don't take full responsibility for the accident.

3. Do Take Pictures Of Both Cars

Lastly, you should always take pictures of the cars in the accident, and any injuries that were sustained. With cameras on cell phones, there is really no reason why you shouldn't be taking a photo of the accident so that you can have it as proof for later. This will help to determine how the accident was caused, what damage was caused, and any other important details. Even if these photos are only used for your personal use, or for your claim to the insurance, it will protect you.
